Your Rights Under the Insurance Act
In Canada, auto insurance policies are governed by provincial Insurance Acts. Most standard policies (like the OAP 1 in Ontario) contain a mandatory provision known as Statutory Conditions.
Statutory Condition 11 (Appraisal) gives you the right to dispute the insurance company's valuation of your total loss vehicle. If you and the insurer cannot agree on the "Actual Cash Value," you can demand an appraisal.
- Binding Decision:
The decision reached by the appraisers (or umpire) is binding on the insurance company.
- Independent Process:
It removes the decision-making power from the adjuster and gives it to independent experts.
- Fair Market Value:

"In the event of disagreement as to the value of the property insured, the property saved or the amount of the loss, those questions shall be determined by appraisal as provided under the Insurance Act before there can be any recovery under this contract..."
