British Columbia Insurance Law

In British Columbia, the insured can invoke the appraisal clause in their insurance policy, which is strengthened by the statutory dispute resolution process under the Insurance Act (RSBC 2012, c. 1, s. 12). Like Saskatchewan, BC uses the term 'dispute resolution representative' rather than 'appraiser' (s. 12(1)). National Appraisers serves as your dispute resolution representative. Each side appoints a representative within 7 days, and the two representatives appoint an umpire within 15 days. Representatives cannot be the insured, insurer, or their employees. If they fail to agree, differences go to the umpire, and the written determination of any 2 of them determines the matters. The Superintendent may appoint an umpire if representatives fail to agree on one (s. 12(10)-(14)).
